Frequently asked questions
Why are rent agreements always eleven months?
Because a tenancy of twelve months or more must be registered under the Registration Act, which costs more and takes longer. Eleven months avoids that requirement, and the agreement is simply renewed. It is a convention born of paperwork rather than of law — there is nothing wrong with a longer registered agreement, and a registered one gives you considerably better protection if it ever comes to a dispute.
Does a rent agreement need to be on stamp paper?
Generally yes. Stamp duty on a rental agreement is set by each state and is usually a small amount for an eleven-month term. An unstamped agreement can be inadmissible as evidence, which is precisely when you would need it. Check your state’s current rate — the tool cannot know it, and it changes.
Is notarisation the same as registration?
No, and the difference matters. Notarisation confirms the signatures are genuine; registration records the document with the sub-registrar and gives it far stronger legal standing. Many landlords stop at notarisation for an eleven-month agreement. For a longer tenancy, or a substantial deposit, registration is worth the cost.
What should the security deposit be?
It varies enormously by city — one or two months’ rent in much of north India, and traditionally as much as ten in parts of the south, though that has been falling. What matters more than the amount is that the agreement says clearly when it is returned, what can be deducted, and that it cannot be adjusted against rent. All three are in this template.
